The important questions include what is owned, what value is created, who bears genuine loss, whether one party’s gain depends on another’s wager and whether uncertainty is hidden or unfair. “Risk-sharing” is therefore a question to verify, not a marketing conclusion.

Abu Hurayrah reported that Prophet Muhammad ﷺ (Peace and blessings be upon him) forbade a sale determined by throwing stones and a sale involving gharar, or material contractual uncertainty.
The report establishes a prohibition concerning the reported pebble sale and gharar in sale. Jurists determine materiality, tolerated uncertainty and application to later contracts.

Sahih Muslim 1513 prohibits gharar sale, while qualified jurists distinguish material contractual gharar from ordinary uncertainty that accompanies lawful activity. State the uncertain element, whether it is avoidable and how it affects the exchange. Qur’an 4:29 contrasts wrongful consumption with trade by mutual consent. Identify the asset, service or productive activity and when ownership, possession and liability change. [David] said, "He has certainly wronged you in demanding your ewe [in addition] to his ewes. And indeed, many associates oppress one another, except for those who believe and do righteous deeds – and few are they." And David became certain that We had tried him, and he asked forgiveness of his Lord and fell down bowing [in prostration] and turned in repentance [to Allāh].
(David) said: He hath wronged thee in demanding thine ewe in addition to his ewes, and lo! many partners oppress one another, save such as believe and do good works, and they are few. And David guessed that We had tried him, and he sought forgiveness of his Lord, and he bowed himself and fell down prostrate and repented.
(David) said: "He has undoubtedly wronged thee in demanding thy (single) ewe to be added to his (flock of) ewes: truly many are the partners (in business) who wrong each other: Not so do those who believe and work deeds of righteousness, and how few are they?"… and David gathered that We had tried him: he asked forgiveness of his Lord, fell down, bowing (in prostration), and turned (to Allah in repentance).

O you who have believed, fulfill [all] contracts.1 Lawful for you are the animals of grazing livestock except for that which is recited to you [in this Qur’ān] – hunting not being permitted while you are in the state of iḥrām.2 Indeed, Allāh ordains what He intends.
O ye who believe! Fulfil your indentures. The beast of cattle is made lawful unto you (for food) except that which is announced unto you (herein), game being unlawful when ye are on the pilgrimage. Lo! Allah ordaineth that which pleaseth Him.
O ye who believe! fulfil (all) obligations. Lawful unto you (for food) are all four-footed animals, with the exceptions named: But animals of the chase are forbidden while ye are in the sacred precincts or in pilgrim garb: for Allah doth command according to His will and plan.

And do not pursue that of which you have no knowledge. Indeed, the hearing, the sight and the heart – about all those [one] will be questioned.

O you who have believed, be persistently standing firm in justice, witnesses for Allāh, even if it be against yourselves or parents and relatives. Whether one is rich or poor, Allāh is more worthy of both. So follow not [personal] inclination, lest you not be just. And if you distort [your testimony] or refuse [to give it], then indeed Allāh is ever, of what you do, Aware.
O ye who believe! Be ye staunch in justice, witnesses for Allah, even though it be against yourselves or (your) parents or (your) kindred, whether (the case be of) a rich man or a poor man, for Allah is nearer unto both (them ye are). So follow not passion lest ye lapse (from truth) and if ye lapse or fall away, then lo! Allah is ever Informed of what ye do.
O ye who believe! stand out firmly for justice, as witnesses to Allah, even as against yourselves, or your parents, or your kin, and whether it be (against) rich or poor: for Allah can best protect both. Follow not the lusts (of your hearts), lest ye swerve, and if ye distort (justice) or decline to do justice, verily Allah is well-acquainted with all that ye do.
